1. Website Use

By using ultimapeak.com (including any subdomains and mobile experiences, the “Website”), you represent that you are at least the age of majority in your state or province of residence and have legal capacity to enter a binding contract. If you do not agree to these Terms, do not use the Website.

Your use of the Website is governed by our Privacy Policy, which is incorporated herein by reference.

3. General Conditions & User Conduct

All Website content is protected by intellectual property laws. You may not use the Website for unlawful purposes or attempts to: hack, scrape, upload malicious code, infringe rights, harass, submit misleading information, collect personal info of others, or interfere with security features. We may suspend or terminate access for any violation.

4. Products for Personal Use Only

Products are sold for personal, non-commercial use only. Resale, redistribution, export, or modification is prohibited without our written consent. We reserve the right to refuse or limit orders that appear to be placed by resellers or distributors.

5. No Medical Advice; Accuracy of Information

Information on the Website is for general informational purposes only and is not medical advice. Statements have not been evaluated by the FDA. Products are not intended to diagnose, treat, cure, or prevent any disease. Consult your healthcare provider before use.

We strive for accuracy but do not guarantee that product descriptions, pricing, or other content is error-free. We may correct errors or cancel orders at any time. Color display may vary by device. Historical information may not be current.

6. Modifications to Website & Prices

We may modify or discontinue the Website, products, or pricing at any time without notice. Certain items may be available online only and in limited quantities.

7. Payment

All prices are in U.S. Dollars unless otherwise stated. By submitting payment, you represent you are authorized to use the payment method and that information provided is accurate. We may receive updated card information from your issuer and update your account accordingly. You are responsible for bank or card fees. If a charge is reversed, we may invoice you directly.

8. Order Placement & Acceptance

Your order confirmation acknowledges receipt of your order—not our acceptance. We may accept or refuse any order and may require additional information before processing. If an order is refused, we will refund the original payment method.

9. Subscriptions, Auto-Payment & Cancellation

You may purchase one-time or enroll in an auto-renewing subscription. By enrolling, you authorize recurring charges to your payment method at the selected interval until cancelled. Prices at enrollment apply unless we notify you of changes in advance as required by law.

  • Billing & Shipping: We bill and ship at your chosen cadence from your initial enrollment date.
  • Change/Cancel: You may cancel anytime, but at least 24 hours before your next scheduled shipment to avoid being charged. Manage via your account or email support@ultimapeak.com.
  • Failed Payments: If payment fails, we may contact you for an alternate method and retry your card.

10. Shipping

We ship to addresses in the U.S. and select international locations. Delivery times vary by destination and carrier. Accurate shipping address and phone number are required. We are not responsible for delays or non-delivery due to incorrect addresses. Contact support immediately for changes; we cannot guarantee edits after submission.

11. Delivery Confirmation

Carrier delivery confirmation is deemed proof of delivery, even without a signature.

12. Returns & Refunds

We want you to be satisfied. If you receive the wrong item or an item arrives damaged/defective, please see our Refund/Returns policy (or contact support@ultimapeak.com) for instructions. Unless otherwise stated, all sales are final after 14 days from order delivery. Refunds are processed to the original payment method after received and inspected; bank posting times vary.

13. Social Media

Our social media channels are not owned or controlled by us. Comments expressed by users are their own. Offensive content should be reported to the platform operator. We may use testimonials and UGC submitted to us in marketing, subject to these Terms.

14. Disclaimer of Warranties

EXCEPT WHERE PROHIBITED BY LAW, THE WEBSITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PRODUCTS OR INFORMATION WILL MEET YOUR EXPECTATIONS OR BE ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ULTIMAPEAK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED USD $500.

16. Dispute Resolution by Binding Arbitration; Class Action Waiver

Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted individually; class or representative actions are waived. You may opt out within 30 days of purchase by emailing support@ultimapeak.com.

17. Indemnification

You agree to indemnify and hold harmless UltimaPeak and affiliates from claims, damages, costs, or expenses arising from your breach of these Terms or violation of law or rights of a third party.

18. Third-Party Websites & Links

We may link to third-party websites. We are not responsible for their content or practices. Use them at your own risk and review their terms and privacy policies.

19. Testimonials, Reviews & Other Submissions

Any submissions you provide (reviews, UGC, testimonials, ideas) may be used by us for marketing in any format, worldwide, royalty-free. By submitting, you represent you own or have rights to the content.

20. DMCA Notice; Intellectual Property

If you believe content infringes your copyright, send notice to support@ultimapeak.com with required details. All Website content is owned or licensed by UltimaPeak. No license is granted except for personal use.

21. Electronic Communications

By using the Website or providing information, you consent to receive communications electronically, which carry the same legal effect as written communication.

22. Assignment

You may not assign rights under these Terms. We may transfer rights and obligations without notice in connection with a merger, acquisition, or sale.

23. No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

24. Severability

If any provision is deemed unenforceable, the remaining provisions remain in effect.

25. Termination

We may terminate these Terms at any time. Upon termination, provisions regarding intellectual property, disclaimers, limitation of liability, and indemnification survive.

26. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and UltimaPeak regarding your use of the Website and purchase of products.

27. Scratch & Win Promotional Program Terms

UltimaPeak may include Scratch & Win cards in packaging or promotions. These rules apply:

  • Eligibility: Must be 18+. Employees/affiliates not eligible. Void where prohibited.
  • How to Play: Scratch panels to reveal prizes. Only original, untampered cards are valid.
  • Prizes: May include gift cards, free product (subject to minimum purchase), or high-value rewards like $1,000. Gift cards redeemable only on ultimapeak.com.
  • Redemption: Claim within 30 days of order delivery via QR code/form. Limit one claim per household. Proof of order may be required.
  • Verification: All claims subject to verification. UltimaPeak decisions are final.
  • Taxes: Winners are responsible for applicable taxes or fees.
  • Delivery: Digital codes sent via email; physical prizes ship to order address. Standard shipping terms apply.
  • Fraud: Attempts to duplicate, tamper, or game the program void eligibility. We may cancel or suspend promotions if abuse occurs.
  • Liability: UltimaPeak not responsible for lost/damaged cards or technical issues. Liability limited to retail value of the prize.
